Promises Gerry made, and how he broke them:
-
★Promise: The old tenants* wanted to move out early, so we could move in when we wanted to.
-
•Broken! The old tenants had said early in the year that they’d consider moving out early, if asked and an arrangement reached.
-
★Promise: The old tenants* would be out by July 15.
-
•Broken! The old tenants finally got the last of their stuff out on August 6, the last day of their original lease.
-
★Promise: Gerry had in writing that the old tenants* would be out on July 15.
-
•Broken! Gerry never got in writing that the old tenants would be out. He may have called them once, around the time my lease was signed, and asked if they’d come in and sign something saying they’d get out. They did not, and Gerry told me a bold-faced lie when I was in the office and talked to him in May. I said, “Did you get anything in writing from them?” Gerry thought for a minute, and then said, “Yes.” A cursory look through his files would have determined that he did not, in fact, have any such document. Gerry later told me he “forgot” and had been “just sure” he had a lease amendment.

★Promise: Gerry would have a maintenance person come by on August 8 (the day after moved in) to fix some of our maintenance issues.
-
•Broken! No one came by to fix these issues. Gerry instead punted the problem into the lap of the condo owner. The owner told me that Gerry had called him and informed him that all his maintenance workers were booked up for a while and that he should probably take care of the issues himself. Some of them have now been resolved (entirely by the owner), but others remain.

★Promise: Gerry would cover the cost of my second truck rental.
-
•Broken! I have yet to see a cent of that money. I submitted my receipts on August 8, the day after I rented the truck, and as of September 15, I have no reimbursement from Gerry or Old Virginia. However, when I accidentally forgot to include my $30 pet rent in September’s payment (the way the lease is written, it’s not included in the “monthly rent” box, it’s a line or two down the page), one of Gerry’s co-workers was on the phone within minutes of receiving the check to leave me a voicemail about the missing pet rent. When I called her back, I indicated she could just deduct the $30 from the nearly $100 Old Virginia owes me. She said she’d “look into it”. That was September 2.
* Note about the old tenants: I don’t want this page to seem like I harbor a grudge against them. I believe they acted entirely within their rights, both legal and contractual, with regards to most of their conduct throughout this move. They were extremely generous in letting me park some of my stuff in the townhouse before they had completely moved out, since I was under pressure to get out of the apartment where another friend had let us camp out for two weeks.
